LHC seeks govt reply in PA building construction dispute

LAHORE, (UrduPoint / Pakistan Point News -7th Sept,2016) : The Lahore High Court (LHC) on Wednesday suspended orders of a civil court on a plea, filed by Husnain Cotex (Pvt) Ltd, regarding the new Punjab Assembly building construction dispute and sought reply from the provincial government.

Justice Mirza Viqas Rauf passed these orders on a petition, challenging the dismissal of its plea seeking directions for implementation of arbitration clause to resolve the dispute over construction of the new Punjab Assembly building.

Earlier, petitioner's counsel Barrister Asjad Saeed, arguing before the court, submitted that the petitioner-company was awarded a contract for construction of the new PA building by the Punjab government.

However, the government claimed that Rs 1 billion amount was due to be recovered from the company and an advertisement was published in newspapers that the contract was being awarded to another company, he added.

He stated that the petitioner-company approached a civil court, in the backdrop of these developments, and pleaded that the government and the company were bound to settle their disputes through arbitration, under the contract.

However, the civil court dismissed the plea without appreciating case facts, he added. He pleaded the court to set aside the civil court verdict. At this, the court, after hearing initial arguments, suspended the verdict of the civil court and sought reply from the government.
