SC Declares Hanif Pathan's Appointment As SPSC Member Illegal

ISLAMABAD, Jan 3 (UrduPoint / Pakistan Point News - 03rd Jan, 2017 ) : The Supreme Court Tuesday declared the appointment of Hanif Pathan as member Sindh Public Service Commission (SPSC) illegal and that of two other members Ghulam Shabir and Sain Dad Solangi legal.
An SC division bench headed by Justice Amir Hani Muslim heard the suo motu notice case regarding appointment of the SPSC chairman and members. During the course of proceedings, SPSC's counsel Farooq H.
Naek informed the court that as per existing law, appointment of commission members was not an easy task. The same procedure for appointment of commission members was adopted in other three provinces, he added.
On this, Justice Amir Hani Muslim asked Naek to submit an application in that regard, adding the court would issue notices to other provinces too. Farooq H. Naek said that the apex court should also take suo moto notice on commission members in other provinces.
Justice Hani remarked that five members of the commission had resigned due to the suo moto notice. Farooq H Naek said the resignation of members did not mean that all of them were ineligible or incompetent as appointing good reputed officers was were in favour of the government itself.
Justice Hani remarked that the court wanted the Sindh Public Service Commission to be functional immediately. The court suggested the Sindh Government to reappoint all eleven members of SPSC. After hearing the arguments of the all the parties, the court declared the appointment of Hanif Pathan as member SPSC illegal and termed appointment of Ghulam Shabir and Sayen Dad Solangi legal.
The court directed the Sindh Government to submit response over legal status of work done by SPSC chairman and members within two weeks.
