Section 144 imposed in federal capital for two months

ISLAMABAD, (UrduPoint / Pakistan Point News - 27th Oct, 2016 ) : The District Magistrate, Islamabad Capital Territory Capt (R) Mushtaq Ahmed has prohibited carrying of firearms, all kind of gatherings of five or more persons and use of loudspeakers and sound amplifiers in Islamabad Capital Territory under Section 144 of Cr.

PC 1898. According to a press note issued here on Thursday, this order shall come into force with immediate effect and shall remain in force for a period of two months. The above mentioned decision will take immediate effect, the press note added.

In order to provide clarity to the extant policy directives contained in the said notification, it is reproduced in its original text below: "Order: Whereas, it has been made to appear to me that certain sections of public are carrying displaying and exhibiting firearms as show of force which is likely to threaten public peace and tranquility and likely to create serious danger to human life and safety of the general public of district Islamabad.

And Whereas, in my opinion there are sufficient grounds for proceeding u/s 144 Cr.PC 1898 and immediate prevention is justified and the directions hereinafter appearing are necessary. Now, Therefore, I, Capt (R) Mushtaq Ahmed, in exercise of powers conferred on me under Section 144 Cr.PC 1998 do hereby order that: No person other than the members of Armed Forces, Civilian Law Enforcement Agencies, Rangers and Police on duty shall carry firearms or display firearms within the revenue/territorial limits of district Islamabad".

This order shall come into force with immediate effect and shall remain in force for a period of two months. Notwithstanding the expiry of this order, everything done, action taken, obligation, liability, penalty or punishment incurred, investigations, enquiry or proceedings pending against offenders in the Court of Magistrates having powers under the Code of Criminal Procedure, 1898 and punishment in respect of this order shall be continued or launched as if this order has not expired.

The above mentioned decision will take immediate effect." In another order, the District Magistrate, Islamabad prohibited all kind of gatherings of five or more persons within the territorial limits of District Islamabad.

In order to provide clarity to the extant policy directives contained in the said notification, it is reproduced in its original text below: "Order: Whereas, it has been brought to appear before me that certain segments of society are planning to organize unlawful assemblies including Majalis/Processions within the jurisdiction of Islamabad Capital Territory which can disrupt public place and tranquility and keeping in view the current law & order and security environment, it is necessary to control such types of illegal activities which present a threat to public peace, tranquility and maintenance of law & order.

And Whereas, based on these reports, certain segments of public are planning to take out religious/sectarian processions and to stage demonstrations in Islamabad Capital Territory which are likely to threaten public peace and tranquility, cause public annoyance or injury, endanger human life and safety, pose a threat to public property and may lead to a riot or any affray including sectarian riot within the revenue/territorial limits of district Islamabad.

Now, Therefore, I, Capt (R) Mushtaq Ahmed, in exercise of powers conferred on me under section 144 Cr. PC 1898 do hereby prohibit all kinds of gatherings of 5 (Five) or more persons, processions/rallies and demonstrations at any public place within the Revenues Limits of District Islamabad, including the Red Zone (comprising area west from the intersection of 3rd Avenue and Murree Road including new Embassy of China Area South of University Road up to the 4th Avenue, area South of Khayaban-e-Iqbal from 4th Avenue upto Ata Turk Avenue, Area East of Ata Turk Avenue upto Jinnah Avenue, Area East of Embassy Road upto Shahrah-e-Suhurwardy, Area North of Shahrah-e-Suhurwardy upto Serena Chowk, Area North of Dhokri Chowk (Convention Center Chowk on Kashmir Highway) upto intersection of Murree Road and 3rd Avenue).

This order shall come into force with immediate effect and shall remain in force for a period of two months. Not withstanding the expiry of this order, everything done, action taken, obligation, liability, penalty or punishment incurred, investigations, enquiry or proceedings pending against the offenders in the Court of Magistrates having powers under the Code of Criminal Procedure, 1898 for violation of the order, shall be implemented as if this order has not expired.

The above mentioned decision will take immediate effect." In another order, the Islamabad administration put a ban on use of loudspeakers and sound amplifiers within the territorial limits of district Islamabad.

According to a press note issued here, District Magistrate stated, "It has been made to appear to me that certain sections of public are using loudspeakers, sound amplifiers and sound systems, thereby causing nuisance and annoyance to the general public and antagonizing the feelings of other social groups/religious sects which is likely to disturb public peace and tranquility, endanger human life and safety, or cause a riot or an affray within the revenue/territorial limits of district Islamabad.

"And whereas, in my opinion there are sufficient grounds for proceed u/s 144 Cr.PC 1898 and immediate prevention and speedy remedy is justified and the directions hereinafter appearing are necessary.

Now, Therefore, I, Capt (R) Mushtaq Ahmed, District Magistrate, Islamabad in exercise of powers conferred on me under section 144 Cr. PC 1898 do hereby prohibit the use of loudspeakers, sound amplifiers and sound systems (except for Azan and Khutaba for Juma Prayers) within the revenue/territorial limits of district Islamabad.

This order shall come into force with immediate effect and shall remain in force for a period of two months. Notwithstanding the expiry of this order, everything done, action taken, obligation, liability, penalty or punishment incurred, investigations, enquiry or proceedings initiated against the accused in the concerned Court having powers under the Code of Criminal Procedure, 1898 for violation of the order, shall be implemented as if this order has not expired.

The above mentioned decision will take immediate effect."
