Huawei CFO Files Lawsuit Against Canada Over 'Breach of Constitutional Rights' - Document

MOSCOW (UrduPoint News / Sputnik - 04th March, 2019) Huawei's Chief Financial Officer, Meng Wanzhou, has filed a lawsuit against the Canadian authorities, alleging that her constitutional rights were seriously violated during her detention� at Vancouver International Airport at the US request back in December, a notice of civil claim, published in Canadian media, showed.

On Friday, the Canadian Department of Justice said the authorities had decided to grant authorization to proceed with the extradition process in Meng's case. The British Columbia Supreme Court has scheduled an appearance date for Wednesday to confirm the extradition authorization and to set the date for the extradition hearing.

"The Defendant CBSA [Canada Border Services Agency] officers, under the guise of a routine border check, unlawfully subjected the Plaintiff to a detention, search and interrogation to extract evidence from her before she was arrested and provided with her rights under the Charter," the notice said.

The notice of civil claim was submitted by law firm Gudmundseth Mickelson LLP, which represents Meng's interests, to the Supreme Court of British Columbia on March 1.

According to Gudmundseth Mickelson LLP, quoted by The Globe and Mail newspaper, the Canadian authorities' actions constitute serious breaches of Meng's constitutional rights, therefore the client seeks damages for "misfeasance in public office and false imprisonment based on alleged multiple failures of those Canadian government officials to comply with the rule of law."

Meng, the daughter of Huawei's founder, was arrested in Vancouver last December at the United States' request, reportedly on suspicions of failing to comply with US sanctions against Iran. The arrest was decried by Beijing, which demanded that Canadian authorities immediately release the Chinese national.

Huawei has insisted Meng has done nothing illegal.
