The decision overturns a lower-court stay, which prevented the Department of Defense from enforcing the ban, while appeals are being heard.

"The District Court's December 11, 2017 order granting a preliminary injunction is stayed pending disposition of the government's appeal in the United States Court of Appeals for the Ninth Circuit," the ruling stated.

The Ninth Circuit is a frequent target of criticism from President Donald Trump, who accuses the circuit of overstepping its authority by issuing decisions that, in effect, create new laws that sidestep Congress.
