IHC Reserves Judgment In Bail Application Of DD CDA

ISLAMABAD, (UrduPoint / Pakistan Point News - 26th july, 2016) : The Islamabad High Court (IHC) reserved judgment in post arrest bail application filed by Deputy Director (DD) Capital Development Authority (CDA) Iftikahar Ali Haideri, cought red handed while taking bribe of Rs.
4 million from the owner of a shopping mall. A division bench comprising Justice Mian Hussan Gul Orangzaib and Justice Muhsan Akhtar Kyani reserved the judgment after hearing the argument presented by the litigant's counsels in the BAIL application moved by the Haideri on medical grounds. During the course of proceedings, Rizwan Abbasi counsel for the petitioner pleaded before the bench that according to the opinion of the medical board constituted to examine health condition of his client, surgery was recommended of the bladder which would not be possible within the jail. Being a premium investigation agency of the state the National Accountability Bureau (NAB) had no jurisdiction to investigate matters less than 100 millions whereas Haideri's matter less than that, Rizwan Abbasi argued.
To support his stance Abbasi presented precedents of the superior courts in which court granted post arrest bails when accused had serious threats to life and necessary to be operated. The Deputy Prosecutor General (DPG) NAB, Sardar Muzaffer Ali objected and said that according to medical board report there was no life threat to the accused moreover authority was willing to operate Haideri in the judicial custody in the hospital of his own choice. After hearing the arguments the bench reserved judgment to announce later. It is pertinent to mention here that on November 30, a joint team headed by NAB officials caught Haideri red-handed while he was receiving Rs.
4 million bribe from Safa Gold Mall owner Rana Abdul Qayyum at a restaurant in the mall's food court. Before the raid, Qayyum had filed an application with NAB Rawalpindi saying that Haideri was demanding illegal favours from him. NAB officials, under the supervision of a magistrate, conducted the raid and arrested Haideri.
