IHC serves notice to ECP in appointment of CM KPK case

ISLAMABAD, Jul 19 (UrduPoint / Pakistan Point News - 19th Jul, 2018 ) :The Islamabad High Court (IHC) Thursday adjourned hearing on a petition till July 24, challenging the appointment of Justice (reted) Dost Muhammad as caretaker Chief Minister Khyber Pakhtunkhwa before general elections.

Justice Mohsin Akhter Kiyani of IHC conducted hearing of the case filed by Haneef Rahi Advocate challenging the appointment of caretaker CM KPK. Advocate General of KPK appeared before the court, however, no representative on behalf of Election Commission of Pakistan (ECP) attend the proceeding.

The petitioner had stated in his plea that Dost Muhammad had been appointed as CM KPK after 46 days of retirement from his post. No one could hold such public office till two years after his retirement from servicein accordance of law, it further stated. He pleaded the court to declare the notification of ECP regarding the appointment of Justice (R) Dost Muhammad as null and void.

After hearing the arguments, the court again served notices to ECP seeking answer in this matter while adjourning the hearing of the case till July 24.
