Justice Shaukat Aziz to challenge his removal in Supreme Court  

Justice Siddiqui will request the apex court to nullify the Law Ministry’s notification removing him as the IHC judge.

Islamabad (UrduPoint / Pakistan Point News – 12th October, 2018) Deposed judge of the Islamabad High Court, Justice Shaukat Aziz Siddiqui has decided to challenge his removal in the Supreme Court.

According to media reports, Justice Siddiqui has been consulting the lawyers in this regard.

The disqualification notification will be challenged in the Supreme Court by Monday, sources said.

Justice Siddiqui will request the apex court to nullify the Law Ministry’s notification removing him as the IHC judge.

IHC Justice, Shaukat Aziz Siddiqui was removed from his office with immediate effect, said a notification issued by Ministry of Law and Justice on Thursday.

"Consequent upon proceedings under article 209(5) and recommendations of the Supreme Judicial Council of Pakistan under article 209(6) read with article 48(1) of the Constitution of Pakistan 1973, the President has been pleased to remove Mr. Justice Shaukat Aziz Siddiqui, Judge, Islamabad High Court from his office with immediate effect," read the removal notification.

Justice Siddiqui was facing a case of alleged misconduct filed against him in the wake of his controversial speech in District Bar Association, Rawalpindi, targeting the superior judiciary and a 'state institution' on July 21, 2018.

The Supreme Judicial Council (SJC) had recommended his removal from the office over his controversial speech.

A five-member SJC bench, headed by Chief Justice of Pakistan (CJP) Mian Saqib Nisar, heard the case. The 39-page opinion penned by Justice Asif Saeed Khosa was sent to President Dr Arif Alvi for further action, who ordered to remove him with immediate effect.

According to the recommendations, Justice Siddiqui had displayed conduct unbecoming of a Judge of a High Court and was, thus, guilty of misconduct and he was, therefore, liable to be removed from his office under Article 209(6) of the Constitution of the Islamic Republic of Pakistan, 1973.
