PTV Can't Recover Fee From Those Having No TV Sets: LHC

LAHORE, (UrduPoint / Pakistan Point News - 22nd Nov, 2016 ) : The Lahore High Court (LHC) on Tuesday disposing of a plea against recovery of ptv fee through electricity bills declaring that the fee could only be recovered from those who possess television sets.
The court held that the fee could not be recovered from those who do not possess television sets. Justice Abid Aziz Sheikh heard the petition, filed by opposition leader in Punjab Assembly Mian Mehmood-ur-Rasheed.
Earlier, the petitioner's counsel Shiraz Zaka submitted that the PTV fee was discriminatory and lacked justification. He argued that the PTV fee had also been imposed on those citizens who even did not have television sets.
Shiraz further argued that the levy of the fee had been imposed in violation of fundamental rights of citizens. However, a deputy attorney general and the legal adviser of the PTV argued that the fee was imposed in accordance with Wireless Telegraphic Act 1933, read with Television Receiving Apparatus Rules 1970.
The court observed that if a person does not have a television set then he should approach the electricity distribution company concerned, along with an affidavit for getting relief.
