Baab Kahanat Aur Bud Faali Se Mutaliq Ehkaam O Masail

Al-Harith narrated that 'Ali said: The Messenger of Allah(S.A.W) judged that the children (sons and daughters) from the same mother and father inherit,not the sons from various mothers.'

حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا أَبُو إِسْحَاق، عَنْ الْحَارِثِ، عَنْ عَلِيٍّ، قَالَ:‏‏‏‏ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ ، ‏‏‏‏‏‏قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ لَا نَعْرِفُهُ إِلَّا مِنْ حَدِيثِ أَبِي إِسْحَاق، ‏‏‏‏‏‏عَنِ الْحَارِثِ، ‏‏‏‏‏‏عَنْ عَلِيٍّ، ‏‏‏‏‏‏وَقَدْ تَكَلَّمَ بَعْضُ أَهْلِ الْعِلْمِ فِي الْحَارِثِ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ عَامَّةِ أَهْلِ الْعِلْمِ.

علی رضی الله عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فیصلہ کیا: ”حقیقی بھائی وارث ہوں گے نہ کہ علاتی بھائی“۔ امام ترمذی کہتے ہیں: ۱- ہم اس حدیث کو صرف ابواسحاق کی روایت سے جانتے ہیں، ابواسحاق سبیعی روایت کرتے ہیں حارث سے اور حارث، علی رضی الله عنہ سے، ۲- بعض اہل علم نے حارث کے بارے میں کلام کیا ہے، ۳- عام اہل علم کا اسی حدیث پر عمل ہے۔

Sunan Ibn Majah Hadith No. 1999

Ali bin Husain said that Miswar bin Makhramah told him that: 'Ali bin Abu Talib proposed to the daughter of Abu Jahl, when he was married to Fatimah the daughter of the Prophet. When Fatimah heard of that she went to the Prophet, and said: Your people are saying that you do not feel angry for your daughters. This 'Ali is going to marry the daughter of Abu Jahl. Miswar said: The Prophet stood up, and I heard him when he bore witness (i.e., said the Shahadah), then he said: 'I married my daughter (Zainab) to Abul-As bin Rabi', and he spoke to me and was speaking the truth. Fatimah bint Muhammad is a part of me, and I hate to see her faced with troubles. By Allah, the daughter of the Messenger of Allah and the daughter of the enemy of Allah will never be joined together in marriage to one man. He said: So, 'Ali abandoned the marriage proposal.

Sahih Bukhari Hadith No. 2781

Narrated Jabir bin `Abdullah Al-Ansari: My father was martyred on the day (of the Ghazwa) of Uhud and left six daughters and some debts to be paid. When the time of plucking the date-fruits came, I went to Allah's Apostle and said, O Allah's Apostle! you know that my father was martyred on Uhud's day and owed much debt, and I wish that the creditors would see you. The Prophet said, Go and collect the various kinds of dates and place them separately in heaps ' I did accordingly and called him. On seeing him, the creditors started claiming their rights pressingly at that time. When the Prophet saw how they behaved, he went round the biggest heap for three times and sat over it and said, Call your companions (i.e. the creditors). Then he kept on measuring and giving them, till Allah cleared all my father's debts. By Allah, it would have pleased me that Allah would clear the debts of my father even though I had not taken a single date to my sisters. But by Allah, all the heaps were complete, (as they were) and I looked at the heap where Allah's Apostle was sitting and noticed as if not a single date had been taken thereof.

Jami at Tirmidhi Hadith No. 990

Umm Atiyyah narrated: One of the daughters of the Prophet died, so he said: 'Wash her an odd number of times, three, or five, or more than that as you see fit. Wash her with water and Sidr, and in the last (washing) add camphor, or something from camphor. When you are finished then inform me.' When we finished we informed him so he gave us his waist-sheet and said 'Wrap her in it.'

Sunan An Nasai Hadith No. 349

It was narrated that 'Aishah said: We went out with the Messenger of Allah (ﷺ) with no intention other than Hajj. When he was in Sarif I began menstruating. The Messenger of Allah (ﷺ) entered upon me and I was weeping. He said: 'What is the matter with you? Has you Nifas begun?' I said: 'Yes.' He said: 'This is something that Allah the Mighty and Sublime has decreed for the daughters of Adam. Do what the pilgrims do but do not perform Tawaf around the House.'

Sahih Bukhari Hadith No. 6387

Narrated Jabir: My father died and left behind seven or nine daughters, and I married a woman. The Prophet said, Did you get married, O Jabir? I replied, Yes. He asked, Is she a virgin or a matron? I replied, She is a matron. He said, Why didn't you marry a virgin girl so that you might play with her and she with you (or, you might make her laugh and she make you laugh)? I said, My father died, leaving seven or nine girls (orphans) and I did not like to bring a young girl like them, so I married a woman who can look after them. He said, May Allah bestow His Blessing on you.

Sunan Ibn Majah Hadith No. 1887

It was narrated that: Abu Ajfa As-Sulami said: “Umar bin Khattab said: 'Do not go to extremes with regard to the dowries of women, for if that were a sign of honor and dignity in this world or a sign of Taqwa before Allah, then Muhammad (ﷺ) would have done that before you. But he did not give any of his wives and none of his daughters were given more than twelve uqiyyah. A man may increase dowry until he feels resentment against her and says: “You cost me everything I own,” or, “You caused me a great deal of hardship.”'” (Hassan)

Jami at Tirmidhi Hadith No. 2092

Jabir bin 'Abdullah said: The wife of Sa'd bin Ar-Rabi came with her two daughters from Sa'd to he Messenger of Allah(S.A.W)and said; O Messenger of Allah(S.A.W)! these two are daughters of Sa'd bin Ar-Rabi who fought along with you on the day of Uhud and was martyred. Their uncle took their wealth, without leaving any wealth for them, and they will not be married unless they have wealth.' He said: 'Allah will decide on that matter.' The ayah about inheritance was revealed, so the Messenger of Allah(S.A.W) sent (word) to their Uncle saying: Give the two daughters of Sa'd two thirds, and give their mother one eighth, and whatever remains, then it is for you.'
